Bibb Co. officers suspended after letting judge drive home after failing alcohol breath test

MACON, Ga. (AP) — The Bibb County sheriff said Thursday that two of his officers will be suspended without pay for their actions at a traffic checkpoint where a local judge was stopped.

Sheriff's officials say officers stopped Bibb County Judge Howard Simms on Sept. 22 for a license check during an operation they called "Rolling Thunder." Sheriff's reports state the judge was allowed to drive home although a roadside breath test showed his alcohol level was above the legal limit.

Sheriff Jerry Modena says a captain will be suspended for five days and a sergeant will be suspended for three days.

Simms, a Superior Court judge and former district attorney, said in a statement last month that he was entering an in-patient alcohol addiction treatment facility. The judge has not been charged with DUI.

Of course he hasn't been charged with DUI. Nor will he ever be charged in THIS incident. A roadside check is not valid evidence. It simply gives LEO enough suspicion to take him in, at which time he would have been tested twice at headquarters/jail on calibrated equipment. Then, if he still failed, the lower of those two readings would be used for DUI charges. Case closed.
