Pair charged in murder of 76-year-old man booked in to Floyd County Jail

The Rome couple charged last month with the murder of 76-year-old Jozell Payne has been booked into the Floyd County Jail after they were arrested in Detroit, Mich., on Nov. 12.

According to Floyd County Jail reports:

Payne’s daughter, Laura Ann Payne, 33, of 304 Chambers St., and her boyfriend, Edward Eugene Gaines, 36, of 1 E. Ninth St., arrived at the jail Wednesday after being extradited from a Wayne County, Mich., facility.

Warrants revealed more charges against both suspects, including accusing them of stealing the victim’s vehicle and two guns.

Laura Payne and Gaines were each charged with felony counts of murder and false imprisonment and three counts of felony theft by taking.

The younger Payne was also charged with probation violation as well as felony counts of aggravated identity fraud and harboring a sex offender.

Gaines had the felony charge of failure to register as a sex offender added as well since he failed to report his change of address within 72 hours of his move from 2005 Dean Ave.

The body of Jozell Payne, 76, was found at his home at 3408 Callier Springs Road on Oct. 18.

Police have yet to release the exact cause of death and are awaiting the results of an autopsy.

Laura Payne and Gaines allegedly held Jozell Payne against his will and prevented him from leaving his home prior to the murder.

They then stole the victim’s 2004 Chevy Avalanche along with his Cobray .45-caliber handgun and Smith and Wesson .38-caliber revolver.

The younger Payne used the victim’s Citi Bank credit card at a Home Depot store on Sept. 21 where she signed the victim’s name and also attempted to add herself onto the account.
