3 ask judge to waive jury trial in kickbacks case

PROVIDENCE, R.I. (AP) — Three people are asking a federal judge in Rhode Island to waive a jury trial in a case that centers on an alleged kickback scheme that prosecutors say cost the U.S. Navy $10 million.

Former civilian engineer Ralph Mariano, of South Arlington, Va., his father, Ralph Mariano Jr., of North Providence, R.I., and his girlfriend, Mary O'Rourke, are scheduled to go before Judge Mary Lisi (LEE'-see) Friday to ask her to decide their guilt or innocence in a bench trial.

O'Rourke worked for a Georgia-based Navy contractor whose founder has pleaded guilty in the case.

Mariano and O'Rourke have pleaded not guilty to charges including conspiracy, theft of government property and wire fraud. Mariano Jr. has pleaded not guilty to tax evasion.
