Circuit Court Judge Charles Price hears arguments Tuesday, March 5, 2013 in Montgomery, Ala., on whether the governor can sign into law a bill providing private school tax credits. Gov. Robert Bentley had planned to sign the bill Tuesday afternoon, but Price temporarily put that on hold while he considers a lawsuit filed by the Alabama Education Association. Price heard arguments Tuesday afternoon on whether the Legislature violated Alabama's open meeting law and its own operating rules in passing the bill in a series of quick votes Thursday night. MONTGOMERY, Ala. (AP) — A Montgomery judge has postponed a decision until Wednesday afternoon on whether to continue blocking the governor from signing a private school tax credit bill.

Circuit Court Judge Charles Price held a hearing Wednesday morning on whether to continue a temporary restraining order that he issued Tuesday, but he delayed a decision until the afternoon.

The judge's delay is to allow him time to consider a motion to dismiss filed by the state attorney general.

The Alabama Education Association is suing state officials to try to keep the governor from signing a bill to provide tax credits to parents who choose to send their children in private schools rather than failing public schools.

Court is scheduled to resume at 1:30 p.m. on Wednesday.
